Abstract

Cooperation agreements constitute important instruments in community economic activities, including the management of village-based tourism sites. Within the context of Islamic economic law, cooperation agreements or contracts (akad) have specific forms that must meet certain pillars (rukun) and validity conditions. This research aims to examine the system of cooperation agreements implemented in managing Banyu Kuwung Bathing Site, Panggang Hamlet, Licin Village, Banyuwangi, and to analyze it from the perspective of Islamic economic law. The study employs a qualitative descriptive method with a field study approach. The findings indicate that cooperation involves several parties, namely the tourism awareness group (Pokdarwis), landowners, and the village government through the Village-Owned Enterprises (BUMDes). The cooperation system includes models of akad ijarah (leasing) and syirkah (partnership), although these agreements have not yet been formalized in written documentation (MOU). From the perspective of Islamic economic law, this practice fulfills the essential pillars and conditions of akad. However, the aspect of written documentation is a significant note, as recommended by the National Sharia Board of the Indonesian Ulema Council (DSN MUI), to prevent potential future disputes
